EULA (End User License Agreement)

This Software Licensing Agreement (the "Agreement") is a legally binding contract between you (hereinafter referred to as "You" or "Licensee") and Mcmap ("Licensor"). By accessing or using McMap Pro, including any downloadable files, HTML source code snippets, and Figma assets provided to you upon purchase (collectively, the"Software"), you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement. If you do not agree with these terms, do not use the Software.
1. License Grant
Subject to your compliance with the terms and conditions of this Agreement, Licensor grants you a non-exclusive, non-transferable, revocable license to use the Software.
2. Licensing Options
Licensor offers two licensing options:
Standard License
The Standard License is designed for individual use and offers a versatile option for creators. While it is intended for single-user access, it serves as an excellent choice for those seeking to build an unlimited number of projects.
Whether you're developing personal websites, crafting web applications for clients, creating commercial software, or working on open-source initiatives, the Standard License provides the flexibility and tools you need to bring your ideas to life. It empowers you to utilize the download files for a wide range of projects, making it an ideal choice for individual developers and small teams.
- This license grants permission to one individual (the Licensee) to access and use the download files.
- Examples of allowed usage include creating personal websites, web applications for clients, commercial SaaS applications, self-hosted web applications, and open-source projects where the primary purpose is not redistributing download files.
- Examples of disallowed usage include creating repositories of McMap Pro elements for public distribution, developing alternative versions of McMap Pro, and creating website builder projects that can be considered as direct competitors of McMap Pro.
Team License
This license extends permission to up to ten (10) Employees and Contractors of the Licensee's organization to access and use the download files. Usage by additional team members beyond this limit requires a separate licensing agreement (ie. a new purchase of a Team License) or an appropriate upgrade.
This license grants the same permissions and restrictions as the Standard License, with the added benefit of accommodating larger teams within the specified limit. The same usage examples and prohibitions as outlined in the Standard License apply.
Please ensure that your organization adheres to the specified team member limit. If you require licensing for more than ten team members, please contact us for further licensing options.
- This license extends permission to all Employees and Contractors of the Licensee to access and use the download files.
- Examples of allowed usage are similar to the Standard License, but it prohibits the creation of any End Product that does not solely belong to the Licensee or its clients. It also prevents employees/contractors from using the Licensee's license for their personal projects.
3. Permitted Actions
Regardless of the licensing option you choose, you are authorized to:
- Create without Limits: You're free to use the download files to make as many End Products as you like, giving your creativity room to grow.
- Make It Your Own: Modify the download files to build new projects while following this license's rules. Customize and adapt to suit your needs.
- Serve Multiple Clients: Use the download files to create countless End Products for any number of Clients. No need to worry about project limits.
- Sell Your Work: Develop End Products for sale to End Users, turning your creations into a source of income.
- Open and Accessible: Build End Products that are open source and freely available to End Users, promoting transparency and inclusivity in your projects.
Here's a list of project examples that designers or web developers can create using McMap Pro's assets while adhering to the permitted actions outlined in the Software Licensing Agreement:
- Website Templates:
- Craft a collection of responsive website templates for various industries, such as e-commerce, portfolio, blog, or business websites. If built for selling (ie. ThemeForest) you need to give proper attribution to McMap.
- Create landing page templates with eye-catching designs and call-to-action elements for marketing purposes.
- Web Applications:
- Develop custom web applications, including admin dashboards, content management systems (CMS), or project management tools, by customizing McMap Pro components.
- Mobile Apps:
- Design and build mobile app interfaces for iOS and Android, ensuring a consistent and appealing user experience.
- Create mobile app prototypes to showcase your design skills to potential clients.
- Digital Art and Illustrations:
- Generate a portfolio of digital art and illustrations, which can be sold as prints, used in branding materials, or featured in online galleries.
- Print Materials:
- Design brochures, flyers, business cards, and posters for both personal and commercial use, showcasing your graphic design expertise.
- Educational Content:
- Develop interactive e-learning modules, online courses, or educational websites with open access to learners of all backgrounds.
- Content Management Systems (CMS):
- Build customizable CMS themes or templates for platforms like WordPress, Joomla, or Drupal, offering users the ability to easily manage their website content. If you're selling the theme you need to give proper attribution to McMap.
- Community Forums:
- Create an open-source community forum platform where users can engage in discussions, share knowledge, and collaborate on various topics.
- E-commerce Themes:
- Design and sell e-commerce themes for popular platforms like Shopify, WooCommerce, or Magento, catering to online store owners. If you are selling the theme you need to give proper attribution to McMap.
- Software Plugins:
- Develop plugins or extensions for widely used software applications, adding new features or functionality to enhance the user experience.
- Portfolio Websites:
- Showcase your own work by building a personal portfolio website, using McMap Pro to highlight your design and development skills.
- Non-Profit Initiatives:
- Collaborate with non-profit organizations to create websites and digital tools that promote social causes and community engagement.
- Startup MVPs:
- Build Minimum Viable Products (MVPs) for startups, helping them bring their ideas to life quickly and cost-effectively.
- Webinars and Events:
- Develop event websites or landing pages for webinars, conferences, or other online events, attracting participants with appealing designs.
- Open-Source Projects:
- Contribute to open-source projects by using McMap Pro assets to improve user interfaces and user experiences in various software applications. They cannot be used to create a direct competitor of McMap Pro.
These project examples demonstrate the versatility of McMap Pro's assets and how designers and web developers can use them to create a wide range of digital and print materials, software applications, and online platforms while adhering to the permitted actions outlined in the Software Licensing Agreement.
4. Prohibited Actions
You are not allowed to perform the following actions:
- No Building Tools for Others: You can't use the download files to create End Products meant for End Users to build their own projects using the download files or derived content.
- No Standalone Distribution: Don't distribute the download files or anything based on them as separate items. They must always be part of a larger End Product.
- No Unauthorized Ownership: You're not allowed to use the download files to create End Products that belong to anyone other than you or your Clients.
- No Direct Competitors: You cannot build a tool or software product that is considered a direct competitor to McMap Pro or offers similar functionality, features, or services as McMap Pro.
5. Liability
Licensor's liability to you for costs, damages, or other losses arising from your use of the Software, including third-party claims against you, is limited to a refund of your license fee. Licensor shall not be held liable for any consequential damages related to your use of the Software.
This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements and understandings, whether oral or written.
6. Miscellaneous
Any amendments or modifications to this Agreement must be posted on this website by Licensor. In the event that any provision of this Agreement is deemed unenforceable, the remaining provisions shall remain in full force and effect.
Please note that this Agreement is subject to change, and it is your responsibility to review it periodically. Your continued use of the Software after any changes to this Agreement, as well as any notifications provided, constitutes acceptance of those changes.
This license agreement was revised on the 29th of September 2023 and the previous license agreement will be applicable for all purchases made before this date.
